Terms & Conditions — 5ph5 User Agreement

1. ACCEPTANCE OF TERMS

These Terms and Conditions ("Agreement") constitute a legally binding contract between you ("User," "Player," "You," or "Your") and 5ph5 ("Company," "We," "Us," or "Our"). This Agreement governs your access to and use of the 5ph5 online gaming platform, including all games, services, features, content, and applications offered through the website located at https://5ph5.cam and any related mobile applications (collectively, the "Platform").

By registering an account, accessing the Platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by all terms set forth in this Agreement, as well as our Privacy Policy and Responsible Gaming policy. If you do not agree to these terms, you must immediately discontinue use of the Platform and refrain from creating an account.

We reserve the right to modify, amend, or update this Agreement at any time without prior notice. All changes become effective immediately upon posting to the Platform. 2. ELIGIBILITY REQUIREMENTS

By registering an account, you represent and warrant that you are of legal age to gamble in the Philippines.

We reserve the right to request proof of age at any time, including but not limited to government-issued identification, passport, driver's license, or other valid documents. Failure to provide adequate verification may result in account suspension or permanent closure, and forfeiture of any account balance.

2.2 Geographic Restrictions

The 5ph5 Platform is intended for use by residents of the Philippines. Users accessing the Platform from jurisdictions where online gambling is prohibited or restricted are solely responsible for compliance with local laws. We do not accept players from countries where online gambling is illegal, and we reserve the right to verify your location and restrict access accordingly.

2.3 Account Limitations

Each User is permitted to maintain only one (1) active account on the Platform. Creating multiple accounts, duplicate accounts, or accounts using false information is strictly prohibited and constitutes a material breach of this Agreement. Users found in violation of this policy will have all accounts permanently closed, and any winnings or bonuses forfeited.

3. ACCOUNT REGISTRATION AND SECURITY

3.1 Registration Process

To access gaming services on the 5ph5 Platform, you must complete the registration process by providing accurate, current, and complete information, including but not limited to your full legal name, date of birth, email address, mobile phone number, and residential address. All information provided must be truthful and verifiable.

You agree to maintain the accuracy of your registration information and to update it promptly if any changes occur. Providing false, misleading, or fraudulent information is grounds for immediate account termination and may result in legal action.

3.2 Account Credentials

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You must not share your login information with any third party. Any activity that occurs under your account is your responsibility, whether authorized by you or not.

If you become aware of any unauthorized access to your account or any security breach, you must notify us immediately via email at [email protected] or through our live chat support. We are not liable for any losses resulting from unauthorized use of your account.

3.3 Identity Verification

We reserve the right to request documentation to verify your identity, age, payment method ownership, and source of funds at any time. Withdrawals and certain account functions may be restricted until verification is completed to our satisfaction. Failure to provide requested documentation within a reasonable timeframe may result in account suspension or closure.

4. DEPOSITS AND PAYMENTS

4.1 Accepted Payment Methods

The 5ph5 Platform accepts deposits via GCash, PayMaya, online banking transfers (BPI, BDO, Metrobank, and other authorized Philippine banks), and cryptocurrency (Bitcoin, Ethereum, USDT). All deposits and account balances are denominated in Philippine Pesos (PHP).

The minimum deposit amount is One Hundred Philippine Pesos (₱100). We do not charge fees for deposits, but your payment provider may impose transaction fees. You are responsible for all fees charged by third-party payment processors.

4.2 Payment Method Ownership

All payment methods used to deposit funds into your 5ph5 account must be registered in your legal name and owned by you personally. Deposits from third-party accounts, joint accounts not bearing your name, or anonymous payment methods are prohibited.

We reserve the right to reverse deposits made from payment methods not registered in your name and to suspend your account pending investigation. You may be required to provide proof of payment method ownership before processing withdrawals.

4.3 Deposit Limits

Users may set voluntary deposit limits through their account settings to promote responsible gaming practices. Once a deposit limit is set, it cannot be increased for a period of twenty-four (24) hours. Decreases to deposit limits take effect immediately.

5. WITHDRAWALS AND PAYOUTS

5.1 Withdrawal Processing

Withdrawals to GCash and PayMaya e-wallets are typically processed within fifteen (15) minutes during business hours. Bank transfer withdrawals are processed within one (1) to three (3) business days, depending on your bank's processing times. Cryptocurrency withdrawals are processed within one (1) hour, subject to blockchain confirmation times.

The minimum withdrawal amount is Two Hundred Philippine Pesos (₱200). Maximum withdrawal limits vary based on your account verification level and VIP status. Standard accounts have a maximum daily withdrawal limit of Fifty Thousand Philippine Pesos (₱50,000).

5.2 Withdrawal Requirements

Before your first withdrawal, you must complete identity verification by submitting valid government-issued identification and proof of address. Withdrawals must be made to a payment method registered in your legal name and verified by our compliance team.

All bonus wagering requirements must be fulfilled before withdrawing any winnings derived from bonus funds. You must wager your initial deposit amount at least one (1) time before requesting a withdrawal to comply with anti-money laundering regulations.

5.3 Withdrawal Fees

The first three (3) withdrawals per calendar month are free of charge. Additional withdrawals may incur a processing fee of Two Percent (2%) of the withdrawal amount, subject to a minimum fee of Fifty Philippine Pesos (₱50). Cryptocurrency withdrawals may be subject to network transaction fees.

6. BONUS TERMS AND PROMOTIONS

6.1 Bonus Eligibility

Bonuses, promotions, and special offers are available to eligible 5ph5 users at our sole discretion. We reserve the right to modify, suspend, or terminate any promotion at any time without prior notice. Participation in promotions is subject to specific terms and conditions applicable to each offer.

Users who violate bonus terms, engage in bonus abuse, or create multiple accounts to claim promotions will have all bonuses and associated winnings forfeited, and their accounts may be permanently closed.

6.2 Wagering Requirements

All bonus funds are subject to wagering requirements before they can be withdrawn. The standard wagering requirement is thirty-five times (35x) the bonus amount. For example, a ₱1,000 bonus requires ₱35,000 in total wagers before withdrawal eligibility.

Different games contribute varying percentages toward wagering requirements. Slot games contribute 100%, live casino games contribute 10%, and sports betting contributes 50%. Specific contribution rates are displayed in the terms of each promotion.

6.3 Bonus Expiration

Bonus funds and free spins expire thirty (30) days after issuance unless otherwise stated in the promotion terms. Unused bonuses and any winnings derived from expired bonuses will be removed from your account automatically.

7. GAME RULES AND CONDUCT

7.1 Fair Play

All users must engage in fair play at all times. Cheating, collusion, exploitation of software vulnerabilities, use of automated betting systems (bots), or any other form of fraudulent activity is strictly prohibited and constitutes a material breach of this Agreement.

We employ sophisticated fraud detection systems and reserve the right to investigate suspicious betting patterns, unusual account activity, or potential rule violations. Users found engaging in prohibited conduct will have their accounts closed, winnings confiscated, and may face legal action.

7.2 Game Outcomes

All games on the 5ph5 Platform use certified Random Number Generators (RNGs) to ensure fair and unpredictable outcomes. Game results are final and binding. We do not reverse game outcomes except in cases of technical malfunction or proven software error.

7.3 Technical Malfunctions

In the event of a technical malfunction, system failure, or software error that affects game outcomes or account balances, we reserve the right to void affected bets and restore accounts to their pre-error state. Players will be notified of significant technical issues affecting their accounts.

8. RESPONSIBLE GAMING

8.1 Self-Exclusion

The 5ph5 Platform provides self-exclusion tools for users who wish to take a break from gambling. Users may self-exclude for periods of six (6) months, one (1) year, or permanently. During the self-exclusion period, your account will be suspended and you will not be able to access gaming services.

To activate self-exclusion, contact our customer support team via live chat or email. Self-exclusion requests are processed within twenty-four (24) hours and cannot be reversed during the exclusion period.

8.2 Deposit and Loss Limits

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial entertainment purposes only. You may not copy, modify, distribute, transmit, display, reproduce, publish, license, create derivative works from, or sell any content obtained from the Platform without our express written permission.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, 5ph5, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of profits, loss of data, loss of winnings, or business interruption.

We do not guarantee uninterrupted or error-free operation of the Platform. Technical issues, server downtime, internet connectivity problems, and software malfunctions may occur. We are not liable for losses resulting from circumstances beyond our reasonable control.

11. ACCOUNT SUSPENSION AND TERMINATION

11.1 Our Right to Terminate

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to: violation of this Agreement, fraudulent activity, underage gambling, duplicate accounts, money laundering, collusion, bonus abuse, abusive behavior toward staff, or any conduct we deem harmful to the Platform or other users.

11.2 Effects of Termination

Upon account termination, your access to the Platform will be immediately revoked. Any remaining account balance, subject to verification of completed wagering requirements and compliance with our terms, will be returned to you via your verified payment method within thirty (30) days, minus any applicable fees or deductions for rule violations.

12. DISPUTE RESOLUTION AND GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or relating to this Agreement or your use of the Platform shall be resolved through good faith negotiation between you and 5ph5.

If a dispute cannot be resolved through negotiation, you agree to submit the matter to binding arbitration in Metro Manila, Philippines, in accordance with the Philippine Arbitration Law. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding on both parties.

14. SEVERABILITY

The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

15. ENTIRE AGREEMENT

This Agreement, together with our Privacy Policy and Responsible Gaming policy, constitutes the entire agreement between you and 5ph5 regarding your use of the Platform and supersedes all prior agreements, understandings, and communications, whether written or oral.
